Sec. 204. Tribal consultation and user input

Except as provided in subsection (b), before expending funds on an Indian dam pursuant to section 201 and not later than 60 days after the date of enactment of this Act, the Secretary shall— consult with the Director of the Bureau of Indian Affairs on the expenditure of funds; ensure that the Director of the Bureau of Indian Affairs advises the Indian tribe that has jurisdiction over the land on which a dam eligible to receive funding under section 202 is located on the expenditure of funds; and solicit and consider the input, comments, and recommendations of the landowners served by the Indian dam.
If the Secretary determines that an emergency circumstance exists with respect to an Indian dam, subsection
(a)shall not apply with respect to that Indian dam.
