Sec. 801. Providing information on health coverage options and health care providers

A State (by itself or jointly with other States) may contract with a private entity to establish a Health Plan and Provider Portal Web site (referred to in this section as a plan portal ) for the purposes of providing standardized information— on health insurance plans that have been certified to be available for purchase in that State; and on price and quality information on health care providers (including physicians, hospitals, and other health care institutions). A plan portal may not directly enroll individuals in health insurance plans or under a State Medicaid plan under title XIX of the Social Security Act ( 42 U.S.C. 1396 et seq. ) or a State child health plan under the State Children's Health Insurance Program established under title XXI of the Social Security Act ( 42 U.S.C. 1397aa et seq. ).
A health insurance issuer offering a health insurance plan through a plan portal may not— be the private entity developing and maintaining a plan portal under this section; or have an ownership interest in such private entity or in the plan portal. An individual employed by a health insurance issuer offering a health insurance plan through a plan portal may not serve as a director or officer for— the private entity developing and maintaining a plan portal under this section; or the plan portal.
Nothing in this section shall be construed to prohibit health insurance brokers and agents from— utilizing the plan portal for any purpose; or marketing or offering health insurance products. In this section, the term State has the meaning given such term for purposes of title XIX of the Social Security Act ( 42 U.S.C. 1396 et seq. ). For purposes of this section, the term health insurance plan does not include coverage of excepted benefits, as defined in section 2791(c) of the Public Health Service Act ( 42 U.S.C. 300gg–91(c) ).
