Sec. 312. Executive Director and staff

The chairperson of the Authority, with the consent of the Authority, shall appoint an Executive Director for the Authority. Subject to subparagraph (B), the Executive Director shall be paid at a rate determined by the Authority. The rate of pay for the Executive Director under subparagraph
(A)may not exceed the basic pay payable for level IV of the Executive Schedule under section 5315 of title 5, United States Code. With the approval of the chairperson, the Executive Director may appoint and fix the pay of additional personnel as the Executive Director considers appropriate, subject to the condition that no individual appointed by the Executive Director may be paid at a rate that exceeds the rate of pay for the Executive Director. The Executive Director and staff of the Authority— may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service; and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of title 5, United States Code, relating to classification and General Schedule pay rates. The Executive Director and staff of the Authority may be appointed and paid without regard to the provisions of the Puerto Rico Code governing appointments and salaries. The provisions of the Puerto Rico Code governing procurement shall not apply to the Authority. On the request of the chairperson, the head of any Federal or Commonwealth government department or agency may detail to the Authority, on a reimbursable or nonreimbursable basis, any of the personnel of the department or agency to assist the Authority in carrying out the duties of the Authority under this title.
