Sec. 243. Compliance with environmental and historic preservation laws

Before conveying eligible facilities under this chapter, the Secretary shall complete all actions required under all applicable laws, including— the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq. ); the Endangered Species Act of 1973 ( 16 U.S.C. 1531 et seq. ); and the National Historic Preservation Act ( 16 U.S.C. 470 et seq. ). The Secretary may not convey an eligible facility under this chapter if the Secretary determines, as part of a review conducted under the National Environmental Policy Act of 1969 and with public input, that making the conveyance will lessen any of the protections afforded under the laws referred to in subsection
(a)or is inconsistent with other applicable requirements to preserve and protect environmental, cultural, and historic assets.
