The Attorney General shall prioritize a request from the Secretary of Homeland Security to transfer a covered alien to the custody of U.S. Immigration and Customs Enforcement before a request from the appropriate official of a State or a subdivision of a State to transfer the covered alien to the custody of such State or subdivision. In this section, the term covered alien means an alien who— is without lawful status in the United States; and is in the custody of the Bureau of Prisons.
