Section 4 of the Clayton Act ( 15 U.S.C. 15 ) is amended by— in subsection (a), by striking Except as provided in subsection
(b)and inserting Except as provided in subsection
(c); by redesignating subsections
(b)and
(c)as subsections
(c)and (d), respectively; and by inserting after subsection
(a)the following: Subsection
(a)shall apply to any common carrier railroad subject to the jurisdiction of the Surface Transportation Board under subtitle IV of title 49, United States Code, without regard to whether such railroad has filed rates or whether a complaint challenging a rate has been filed. .
