Section 18 of the Federal Power Act ( 16 U.S.C. 811 ) is amended— in the first sentence, by inserting after the Secretary of Commerce the following: or the Secretary of the Interior, as appropriate, but only if the fishways are necessary to mitigate effects of the project on fish populations, have a clear and direct nexus to the presence or operations of the project being licensed, as determined by the Commission, and are submitted in accordance with the schedule established under section 35 ; and by striking the second, third, and fourth sentences.
