Section 501(c)(12)(E) is amended by striking means the Federal Energy Regulatory Commission and all that follows and inserting: means— the Federal Energy Regulatory Commission, and in the case of any utility with respect to which all of the electricity generated, transmitted, or distributed by such utility is generated, transmitted, distributed, and consumed in the same State, the State agency of such State with the authority to regulate electric utilities. . The amendment made by this section shall take effect as if included in section 319 of the American Jobs Creation Act of 2004.
