None of the funds made available by this Act to the Department of Education may be used to withhold Federal financial assistance to public educational institutions for alleged violations described in the letter dated May 13, 2016, issued jointly by the Department of Justice and the Department of Education, or substantially similar alleged violations, until such violations have been generally recognized by appropriate courts of the United States in final and unappealable judgments (including the exhaustion of or expiration of the time for any appeals), and such alleged violations have been determined by the applicable court to have occurred.
