The Secretary shall manage future designated routes on the Trail in a manner that— is consistent with section 902; and does not interfere with private property or water rights. The Secretary, in consultation with the State and the County, may temporarily close or permanently reroute, subject to subparagraph (C), a route on the Trail if the Secretary determines that— the route is significantly damaging designated critical habitat or cultural resources; the route threatens public safety; closure of the route is necessary to repair damage to the Trail; or closure of the route is necessary to repair resource damage.
Portions of the route that are temporarily closed may be permanently rerouted by utilizing a previously closed route or constructing a new route. The Secretary shall provide information to the public regarding any designated routes on the Trail that are open, have been relocated, or are temporarily closed through— use of appropriate signage within the Trail; and use of the Internet and Web resources. Nothing in this title affects ownership, management, or other rights relating to non-Federal land or interests in non-Federal land.
Not later than 180 days after the date of enactment of this Act, the Secretary shall study the feasibility and public interest in constructing new routes as part of the Red Rock County Off-Highway Vehicle Trail to further off-highway vehicle recreational opportunities. If the Secretary determines that the construction of a route on the Trail is feasible, construction is authorized. A route on the Trail may be constructed under this subsection through the acceptance of volunteer services and contributions from non-Federal sources to eliminate the need for Federal expenditures to construct the route.
In carrying out this subsection, the Secretary shall comply with— the Federal Land Policy and Management Act of 1976 ( 43 U.S.C. 1701 et seq. ); this title; and other applicable law.
