None of the funds made available in this Act or transferred pursuant to section 1017 of Public Law 111–203 may be used to enforce the provisions of section 129 of the Truth in Lending Act ( 15 U.S.C. 1639 ) for any transaction that is less than $75,000 and is secured by a dwelling that is personal property or is a transaction that does not include the purchase of real property on which a dwelling is to be placed if— the annual percentage rate at consummation of the transaction, as determined under section 103(bb) of the Truth in Lending Act ( 15 U.S.C. 1602(bb) ) does not exceed 10 percentage points; and the total points and fees payable in connection with the transaction, as determined under such section 103(bb), do not exceed the greater of 5 percent or $3,000.
