Chapter 17 is amended by inserting after section 1703A, as added by section 101, the following new section: If, in making payments to non-Department health care providers under contracts or sharing agreements entered into pursuant to this chapter or any other provision of law, the Secretary is required to pay any fees or penalties by reason of not fully complying with chapter 39 of title 31 (commonly referred to as the Prompt Payment Act ), such fees or penalties shall be derived from the Medical Services account of the Department.
On a quarterly basis during fiscal years 2018 through 2022, the Secretary shall submit to the Committees on Veterans Affairs of the House of Representatives and the Senate a report, with respect to the quarter covered by the report, identifying each fee or penalty paid by the Secretary for not fully complying with chapter 39 of title 31 as described in subsection
(a)and including an explanation of the reason the Secretary did not fully comply with such chapter 39. . The table of sections at the beginning of chapter 17 is amended by inserting after the item relating to section 1703A, as added by section 101, the following new item: 1703B. Payment of health care providers. .
