Sec. 1085. Clarification of contracts covered by airlift service provision

Section 9516 of title 10, United States Code, is amended by adding at the end the following new subsection: In this section, the term contract for airlift service means— a contract with the Department of Defense for airlift service; any contract with the Department of Defense other than a contract described in paragraph (1), if transportation services are used in the performance of the contract; or any subcontract (at any tier) under a contract described in paragraph
(1)or
(2)if the subcontract is for airlift service or if transportation services are used in the performance of the subcontract. .
