Section 106 of title 49, United States Code, is amended by adding at the end the following: There shall be a Designated Agency Safety and Health Officer appointed by the Administrator, not later than 180 days after the date of enactment of this subsection, who shall exclusively fulfill the duties prescribed in this subsection. The Designated Agency Safety and Health Officer shall have responsibility and accountability for— auditing occupational safety and health issues across the Administration; overseeing Administration-wide compliance with relevant Federal occupational safety and health statutes and regulations, national industry and consensus standards, and Administration policies; and encouraging a culture of occupational safety and health to complement the Administration’s existing safety culture.
The Designated Agency Safety and Health Officer shall occupy a full-time, senior executive position and shall report directly to the Assistant Administrator for Human Resource Management. The Designated Agency Safety and Health Officer shall have demonstrated ability and experience in the establishment and administration of comprehensive occupational safety and health programs and knowledge of relevant Federal occupational safety and health statutes and regulations, national industry and consensus standards, and Administration policies.
The Designated Agency Safety and Health Officer shall serve at the pleasure of the Administrator. .
