Sec. 105. Clarification regarding authority for flexible personnel management among elements of intelligence community

Section 102A(v) of the National Security Act of 1947 ( 50 U.S.C. 3024(v) ) is amended— by redesignating paragraph
(3)as paragraph (4); and by inserting after paragraph
(2)the following new paragraph (3): A covered department may appoint an individual to a position converted or established pursuant to this subsection without regard to the civil-service laws, including parts II and III of title 5, United States Code. . The amendments made by subsection
(a)shall apply with respect to an appointment under section 102A(v) of the National Security Act of 1947 ( 50 U.S.C. 3024(v) ) made on or after the date of the enactment of the Intelligence Authorization Act for Fiscal Year 2012 ( Public Law 112–87 ) and to any proceeding pending on or filed after the date of the enactment of this section that relates to such an appointment.
