If the Director determines that a proposed renewable energy project has been sufficiently analyzed by a programmatic environmental impact statement conducted under section 202(b), the head of the applicable Federal agency shall not require any additional review under the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq. ). If the Director determines that additional environmental review under the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq. ) is necessary for a proposed renewable energy project, the head of the applicable Federal agency shall rely on the analysis in the programmatic environmental impact statement conducted under section 202(b), to the maximum extent practicable when analyzing the potential impacts of the project.
