Section 16 of the Toxic Substances Control Act ( 15 U.S.C. 2615 ) is amended— in subsection (a)(1)— in the first sentence, by striking $25,000 and inserting $37,500 ; and in the second sentence, by striking violation of section 15 or 409 and inserting violation of this Act ; and in subsection (b)— by striking Any person who and inserting the following: Any person that ; by striking $25,000 and inserting $50,000 ; and by adding at the end the following: Any person that knowingly or willfully violates any provision of section 15 or 409, and that knows at the time of the violation that the violation places an individual in imminent danger of death or serious bodily injury, shall be subject on conviction to a fine of not more than $250,000, or imprisonment for not more than 15 years, or both.
An organization that commits a violation described in subparagraph
(A)shall be subject on conviction to a fine of not more than $1,000,000 for each violation. Subparagraphs
(B)through
(F)of section 113(c)(5) of the Clean Air Act ( 42 U.S.C. 7413(c)(5) ) shall apply to the prosecution of a violation under this paragraph. .
