Section 16 of the Toxic Substances Control Act ( 15 U.S.C. 2615 ) is amended— in subsection (a)(1), by striking $25,000 and inserting $37,500 ; and in subsection (b)— by striking Any person and inserting the following: Any person ; by striking $25,000 and inserting $50,000 ; and by adding at the end the following: Any person who knowingly and willfully violates any provision of section 15 or 409, and who knows at the time of the violation that the violation places an individual in imminent danger of death or serious bodily injury, shall be subject on conviction to a fine of not more than $250,000, or imprisonment for not more than 15 years, or both.
Notwithstanding the penalties described in subparagraph (A), an organization that commits a knowing violation described in subparagraph
(A)shall be subject on conviction to a fine of not more than $1,000,000 for each violation. Subparagraphs
(B)through
(F)of section 113(c)(5) of the Clean Air Act ( 42 U.S.C. 7413(c)(5)(B) –(F)) shall apply to the prosecution of a violation under this paragraph. .
