Section 31137 is amended— by redesignating subsections
(f)and
(g)as subsections
(h)and (i), respectively; and by inserting before subsection (h), as redesignated, the following: The Secretary may require an electronic logging device provider to— provide the purchaser or lessee of an electronic logging device, in a manner the Secretary considers appropriate, any information or notice that the Secretary considers necessary; and maintain records of electronic logging device purchasers and lessees in order to provide any information or notice required under paragraph
(1)of this subsection. The Secretary shall notify an electronic logging device provider after making a preliminary decision that an electronic logging device does not comply with the standards established through the regulations prescribed under subsection
(a)in effect at the time of certification. The Secretary shall publish notice of each preliminary decision in the Federal Register. The Secretary may make a final decision that an electronic logging device does not comply with the standards only after— giving the electronic logging device provider an opportunity to— correct the deficiency in order that the electronic logging device complies with the standards; or present information to show that the electronic logging device complies with the standards; and giving any other interested person an opportunity to present information as to the electronic logging device’s noncompliance. If the Secretary makes a final decision that an electronic logging device does not comply with the standards in effect at the time of certification, the Secretary shall order the electronic logging device provider to give notice under subsection
(f)of this section to each purchaser or lessee of the electronic logging device that the electronic logging device provider has been required to— recall the electronic logging device; and remedy the defect so that the purchaser or lessee of the electronic logging device obtains a compliant electronic logging device within a reasonable time and in accordance with the terms prescribed by the Secretary. .
