Sec. 701. Joint uniform formulary for transition of care

Not later than June 1, 2016, the Secretary of Defense and the Secretary of Veterans Affairs shall jointly establish a joint uniform formulary for the Department of Veterans Affairs and the Department of Defense with respect to pharmaceutical agents that are critical for the transition of an individual from receiving treatment furnished by the Secretary of Defense to treatment furnished by the Secretary of Veterans Affairs. The Secretaries shall select for inclusion on the joint uniform formulary established under subsection
(a)pharmaceutical agents relating to— the control of pain, sleep disorders, and psychiatric conditions, including post-traumatic stress disorder; and any other conditions determined appropriate by the Secretaries. Not later than July 1, 2016, the Secretaries shall jointly submit to the appropriate congressional committees a report on the joint uniform formulary established under subsection (a), including a list of the pharmaceutical agents selected for inclusion on the formulary. In this section: The term appropriate congressional committees means— the congressional defense committees; and the Committees on Veterans’ Affairs of the House of Representatives and the Senate. The term pharmaceutical agent has the meaning given that term in section 1074g(g) of title 10, United States Code. Section 1074g(a)(2)(A) of title 10, United States Code, is amended by adding at the end the following new sentence: With respect to members of the uniformed services, such uniform formulary shall include pharmaceutical agents on the joint uniform formulary established under section 701 of the National Defense Authorization Act for Fiscal Year 2016. .
