Sec. 1040. Submission to Congress of certain documents relating to transfer of individuals detained at Guantanamo to Qatar

Not later than 30 days after the date of the enactment of this Act, the Attorney General and the Secretary of Defense shall submit to the congressional defense committees and the Committees on the Judiciary of the Senate and House of Representatives all covered correspondence. For purposes of this section, the term covered correspondence — means any correspondence between the Department of Defense and the Department of Justice or any other agency or entity of the United States Government that— relates to the transfer of individuals detained at United States Naval Station, Guantanamo Bay, Cuba, to Qatar; is dated any time between January 1, 2013, and June 1, 2014; and is in the custody of the Department of Justice or the Department of Defense; and includes— all relevant correspondence, including the email exchange described in June 11, 2014, testimony to the Committee on Armed Services of the House of Representatives by the Secretary of Defense and the General Counsel of the Department of Defense; and any analysis of— section 1035 of the National Defense Authorization Act for Fiscal Year 2014 ( Public Law 113–66 ; 127 Stat. 851; 10 U.S.C. 801 note); section 8111 of the Consolidated Appropriations Act, 2014 ( Public Law 113–76 ; 128 Stat. 131); section 1341 of title 31, United States Code (popularly known as the Antideficiency Act ); or Article II of the Constitution.
Of the amounts authorized to be appropriated or otherwise made available for the Office of the Secretary of Defense for fiscal year 2016, not more than 75 percent may be obligated or expended until the date of the submission of all covered correspondence.
