Subsection
(b)of section 127d of title 10, United States Code, is amended by adding at the end the following new paragraph: Clause
(ii)of paragraph (2)(B) does not apply in a case in which the Secretary determines that the provision of assistance is critical to the timely and effective participation of the allied forces in the combined operation. .
