Notwithstanding section 2821(b) of the Military Construction Authorization Act for Fiscal Year 2015 (division B of Public Law 113–291 ; 128 Stat. 3701), the Secretary of Defense may proceed with a public infrastructure project intended to improve water and wastewater systems on Guam if— the project was identified in the report prepared by the Secretary of Defense under section 2822(d)(2) of the Military Construction Authorization Act for Fiscal Year 2014 (division B of Public Law 113–66 ; 127 Stat. 1017); and amounts have been appropriated or made available to be expended by the Department of Defense for the project.
