Nothing in the amendments made by this subtitle is intended to alter or affect the ability of— the Secretary of Health and Human Services to take enforcement actions with respect to a violation of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 301 et seq. ), including section 301 of such Act ( 21 U.S.C. 331 ); or the Secretary of Agriculture to take enforcement actions with respect to a violation of the Plant Protection Act ( 7 U.S.C. 7701 et seq. ), including section 411 of such Act ( 7 U.S.C. 7711 ).
