Subtitle E of title XII of the Food Security Act of 1985 ( 16 U.S.C. 3841 et seq. ) is amended by adding at the end the following: The Secretary shall promulgate such regulations as are necessary to implement programs under this title, including such regulations as the Secretary determines to be necessary to ensure a fair and reasonable application of the limitations established under section 1244(f). The promulgation of regulations and administration of programs under this title— shall be carried out without regard to— the Statement of Policy of the Secretary effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices of proposed rulemaking and public participation in rulemaking; and chapter 35 of title 44, United States Code (commonly known as the Paperwork Reduction Act); and shall be made as an interim rule effective on publication with an opportunity for notice and comment.
In promulgating regulations under this section, the Secretary shall use the authority provided under section 808 of title 5, United States Code. .
