Section 1231(a) of the Food Security Act of 1985 ( 16 U.S.C. 3831(a) ) is amended— by striking 2012 and inserting 2018 ; and by inserting or easements after contracts . Section 1231(b) of the Food Security Act of 1985 ( 16 U.S.C. 3831(b) ) is amended— in paragraph (1)(B), by striking the Food, Conservation, and Energy Act of 2008 and inserting ; Balancing Food, Farm, and the Environment Act of 2013 by striking paragraph
(2)and inserting the following new paragraph: grassland that— contains forbs or shrubland (including improved rangeland and pastureland) for which grazing is the predominant use; is located in an area historically dominated by grassland; and could provide habitat for animal or plant populations of significant ecological value, or corridors to facilitate wildlife movement and migration, if the land is retained in its current use or restored to a natural condition; ; and in paragraph (4)— in subparagraph (C)— by inserting , wildlife habitat buffers, shallow water areas for wildlife after permanent wildlife habitat ; by inserting , wetland buffers, riparian buffers after shelterbelts ; and by striking devoted to trees or shrubs ; by redesignating subparagraphs
(D)and
(E)as subparagraphs
(E)and (F), respectively; and by inserting after subparagraph
(C)the following new subparagraph: the land will be devoted to nutrient-trapping conservation practices approved by the Secretary used in association with a newly created or existing conservation buffer practice; . Subsections
(c)and
(d)of section 1231 of the Food Security Act of 1985 ( 16 U.S.C. 3831 ) are amended to read as follows: For purposes of determining the eligibility of land to be placed in the conservation reserve established under this subchapter, land shall be considered to be planted to an agricultural commodity during a crop year if, during the crop year, the land was devoted to a conserving use. The Secretary may maintain in the conservation reserve at any 1 time during— fiscal year 2014, no more than 26,000,000 acres; fiscal year 2015, no more than 25,000,000 acres; fiscal year 2016, no more than 24,000,000 acres; and fiscal years 2017 and 2018, no more than 23,000,000 acres. The Secretary, to the maximum extent feasible, shall manage the conservation reserve to ensure that on an annual basis not less than 600,000 acres are available for new enrollments of eligible land— described in subparagraphs
(B)through
(F)of subsection (b)(4); and enrolled under the special conservation reserve enhancement program authority under section 1234(f)(4). The Secretary shall give priority to enrollments under the reservation in paragraph
(2)to land located in nutrient-impacted watersheds for which the enrollment would reduce nutrient loadings, as determined by the Secretary. In applying paragraph (3), the Secretary shall take into consideration the effects that may exist of any drainage infrastructure on the potential to reduce nutrient loadings. .
