Not later than December 31, 2013, the Secretary of Labor, acting through the Assistant Secretary of Labor for Mine Safety and Health, shall submit to the Director of the Office of Management and Budget and to the Congress, and post on the public website of the Mine Safety and Health Administration, a 5-year strategic plan for program activities. Such plan shall be— prepared in accordance with the requirements for agency strategic plans under section 306 of title 5, United States Code, except as otherwise provided in this section; aligned with the strategic plan of the Department of Labor; and revised at least once every 4 years.
Beginning with the Mine Safety and Health Administration budget submission for fiscal year 2015, the Secretary of Labor, acting through the Assistant Secretary of Labor for Mine Safety and Health, shall submit to the Director of the Office of Management and Budget an annual performance plan covering each program activity set forth in the budget of the Mine Safety and Health Administration. Such plan shall— be prepared in accordance with the requirements for performance plans under section 1115 of title 31, United States Code, except as otherwise provided in this section; be consistent with the strategic plan of the Mine Safety and Health Administration under subsection (a); and include a strategic workforce plan that provides a clear line of sight between the performance goals and objectives of the Mine Safety and Health Administration and the human capital strategies employed to meet such goals and objectives.
Not later than 150 days after the end of each fiscal year, beginning with fiscal year 2015, the Secretary of Labor, acting through the Assistant Secretary of Labor for Mine Safety and Health, shall prepare and submit to the President and Congress, and post on the public website of the Mine Safety and Health Administration, a report on the program performance for the previous fiscal year. Such report shall— be prepared in accordance with the requirements for program performance reports under section 1116 of title 31, United States Code; and address the extent to which the Mine Safety and Health Administration is using performance information to improve program performance.
