Nothing in this Act shall be construed to prohibit children eligible for assistance under title I or III of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 6301 et seq. , 6801 et seq.) or children eligible for assistance under the Individuals with Disabilities Education Act from receiving literacy instruction and intervention under this Act. The screening assessments, diagnostic assessments, and formative assessment processes of reading and writing authorized under this Act shall not be construed to constitute an evaluation required under the Individuals with Disabilities Education Act, except that assessments administered under this Act may be used in conjunction with other assessments as part of an evaluation under the Individuals with Disabilities Education Act, provided that all assessment requirements of such Act are met.
