Section 11 of the Toxic Substances Control Act ( 15 U.S.C. 2610 ) is amended to read as follows: For purposes of administering this Act, the Administrator, and any duly designated representative of the Administrator, may inspect— any establishment, facility, or other premises in which chemical substances, mixtures, or articles subject to this Act are manufactured, processed, stored, or held before or after distribution in commerce; any conveyance being used to transport such chemical substances, mixtures, or articles in connection with distribution in commerce; and any place at which records relating to the chemical substances, mixtures, or articles, or otherwise relating to compliance with this Act, are held.
Each inspection under paragraph
(1)shall be— commenced and completed with reasonable promptness; and conducted at reasonable times, within reasonable limits, and in a reasonable manner. The Administrator, and any duly designated representative of the Administrator, may inspect and obtain samples of any— chemical substance, mixture, or article; and container or labeling of a chemical substance, mixture, or article. An inspection conducted under subsection
(a)shall extend to all things within the premises or conveyance inspected (including records, files, papers, processes, controls, and facilities) regarding whether the owner or operator of the premises, conveyance, or records has complied with provisions of this Act applicable to the chemical substances, mixtures, articles, or records. In carrying out this Act, the Administrator may require the attendance and testimony of witnesses and the production of such reports, papers, documents, items, answers to questions, and other information, including the development of analyses and other information, as the Administrator determines to be necessary. A witness described in paragraph
(1)shall be paid the same fees and mileage that are paid witnesses in the courts of the United States. For purposes of enforcing this Act, upon a showing to an officer or court of competent jurisdiction that there is reason to believe that a provision of this Act has been violated, officers or employees duly designated by the Administrator are empowered to obtain and to execute warrants authorizing— entry, inspection, and copying of records for purposes of this Act; and the seizure of any chemical substance, mixture, or article that is in violation of this Act. .
