Sec. 7. Board of trustees for the Fund

There is hereby established (as a permanent, independent establishment in the executive branch) a Board of Trustees for the Fund for Medical Innovation Prizes. The Board shall be composed of 13 members, including— the Administrator of the Centers for Medicare & Medicaid Services; the Commissioner of Food and Drugs; the Director of the National Institutes of Health; the Director of the Centers for Disease Control and Prevention; and 9 individuals to be appointed by the President, with the advice and consent of the Senate, of which— 2 shall be representatives of businesses that provide health insurance to employees; 2 shall be representatives of entities that provide health insurance and contribute to the co-funding of the Fund for Medical Innovation Prizes under section 17; 2 shall be representatives of the medical research and development sector, including at least 1 representative of the nonprofit private medical research and development sector; and 3 shall be representatives of consumer and patient interests, including at least one representative of patients suffering from orphan diseases.
Except as provided in paragraph (2), each member appointed to the Board under subsection (b)(5) shall be appointed for a term of 4 years. As designated by the President at the time of appointment, of the members first appointed to the Board under subsection (b)(5)— 5 members shall be appointed for a term of 4 years; and 4 members shall be appointed for a term of 2 years. Any member of the Board appointed to fill a vacancy occurring before the expiration of the term for which the member's predecessor was appointed shall be appointed only for the remainder of that term.
A member of the Board may serve after the expiration of that member's term until a successor has taken office. Members of the Board shall each be paid not less than the daily equivalent of level IV of the Executive Schedule for each day (including travel time) during which they are engaged in the actual performance of the duties of the Board. Each member of the Board shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of chapter 57 of title 5, United States Code.
The members of the Board shall elect a Chairperson and any other officers of the Board. The Chairperson and any such officers shall be elected for a term of 2 years. The Board may appoint and fix the pay of such additional personnel as the Board considers appropriate. The staff of the Board shall be appointed subject to the provisions of title 5, United States Code, governing appointments in the competitive service, and shall be paid in accordance with the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates.
The Board may procure temporary and intermittent services under section 3109(b) of title 5, United States Code.
