There is established in the Treasury of the United States a fund, to be known as the Birch Creek Mitigation Fund (referred to in this section as the Fund ), to be used to mitigate the impacts of development of the tribal water right described in article III.C.1. of the Compact on the Birch Creek water supplies of the Pondera County Canal and Reservoir Company Project. The Secretary, acting through the Commissioner of Reclamation, shall manage the Fund in accordance with this section. Amounts from the Fund may not be disbursed until the expiration of the Birch Creek Agreement. There are authorized to be appropriated such sums as are necessary to carry out this section.
