Section 3 ( 16 U.S.C. 1802 ) is amended— by inserting after paragraph
(8)the following: The terms depleted and depletion mean, with respect to a stock of fish in a fishery, that the stock is of a size that jeopardizes the capacity of the fishery to produce the maximum sustainable yield on a continuing basis. ; in paragraph (33)(C), by inserting or otherwise depleted after overfished ; in paragraph (36), by inserting , tribal, after State, ; by inserting after paragraph

Section 104(f)(4)(B) of the Compact of Free Association Act of 1985 ( 48 U.S.C. 1904(f)(4)(B) ) is amended by striking have the same meanings as provided in paragraphs
