Section 313 ( 20 U.S.C. 1059 ) is amended by adding at the end the following: The Secretary shall not award grant funds for the fourth or fifth year of a grant under this part unless the Secretary determines that the grantee is making progress in implementing the activities described in the grantee's application under section 391 at a rate that will result in the full implementation of such activities before the end of the grant period. The Secretary shall consider any data or information provided to the Department by grantees for the continued receipt of grants under this title under paragraph
(1)that is considered in accordance with regulations issued by the Secretary before the date of enactment of the Higher Education Affordability Act. Any requirements the Secretary develops for institutions in accordance with regulations issued by the Secretary after the date of enactment of the Higher Education Affordability Act to carry out this subsection shall take into account the capacity and resources of institutions to comply with such requirements. .
