Up to $93,000,000 of the funds made available in title III of this Act pursuant to or to carry out the provisions of part I of the Foreign Assistance Act of 1961 may be used by the United States Agency for International Development (USAID) to hire and employ individuals in the United States and overseas on a limited appointment basis pursuant to the authority of sections 308 and 309 of the Foreign Service Act of 1980. The number of individuals hired in any fiscal year pursuant to the authority contained in subsection
(a)may not exceed 175. The authority to hire individuals contained in subsection
(a)shall expire on September 30, 2016. The authority of subsection
(a)should only be used to the extent that an equivalent number of positions that are filled by personal services contractors or other non-direct hire employees of USAID, who are compensated with funds appropriated to carry out part I of the Foreign Assistance Act of 1961, are eliminated. The account charged for the cost of an individual hired and employed under the authority of this section shall be the account to which such individual's responsibilities primarily relate: , That funds made available to carry out this section may be transferred to, and merged with, funds appropriated by this Act in title II under the heading Provided Operating Expenses . Individuals hired and employed by USAID, with funds made available in this Act or prior Acts making appropriations for the Department of State, foreign operations, and related programs, pursuant to the authority of section 309 of the Foreign Service Act of 1980, may be extended for a period of up to 4 years notwithstanding the limitation set forth in such section. Funds appropriated under title III of this Act to carry out part I of the Foreign Assistance Act of 1961 may be used, in addition to funds otherwise available for such purposes, for the cost (including the support costs) of individuals detailed to or employed by USAID whose primary responsibility is to carry out programs in response to natural or man-made disasters subject to the regular notification procedures of the Committees on Appropriations. Funds appropriated by this Act to carry out chapter 1 of part I, chapter 4 of part II, and section 667 of the Foreign Assistance Act of 1961, and title II of the Food for Peace Act (Public Law 83–480), may be used by USAID to employ up to 40 personal services contractors in the United States, notwithstanding any other provision of law, for the purpose of providing direct, interim support for new or expanded overseas programs and activities managed by the agency until permanent direct hire personnel are hired and trained: , That not more than 15 of such contractors shall be assigned to any bureau or office: Provided , That such funds appropriated to carry out title II of the Food for Peace Act (Public Law 83–480), may be made available only for personal services contractors assigned to the Office of Food for Peace. Provided further In entering into multiple award indefinite-quantity contracts with funds appropriated by this Act, USAID may provide an exception to the fair opportunity process for placing task orders under such contracts when the order is placed with any category of small or small disadvantaged business. Individuals hired pursuant to the authority provided by section 7059(o) of division F of Public Law 111–117 may be assigned to or support programs in Afghanistan or Pakistan with funds made available in this Act and prior Acts making appropriations for the Department of State, foreign operations, and related programs. Not later than 90 days after enactment of this Act and after consultation with the appropriate congressional committees, the USAID Administrator shall establish a new Foreign Service Officer position designated as Local Sustainable Development Officer , and submit to the Committees on Appropriations a plan to establish such position, including— specifying a time period for overseas assignments that facilitates sustainable development, and which includes the option of extending such overseas assignments; sufficient foreign language training; expertise in one or more program areas; position descriptions that give such officers primary responsibility for building relationships with and the capacity of local nongovernmental and governmental entities, and supporting grants to and cooperative agreements with such entities to design and implement small-scale, sustainable programs, projects, and activities across all development sectors; incentives, including training, compensation, and career development opportunities, to encourage such officers to carry out their responsibilities; and ensuring that the responsibilities and assignments of relevant locally employed staff are fully integrated with the work of such officers. The USAID Administrator shall— offer to current USAID Foreign Service Officers the opportunity to convert to a Local Sustainable Development Officer position; and designate not less than half of the total number of Foreign Service Officer positions that become vacant annually due to attrition as Local Development Sustainable Officer positions. Funds appropriated by this Act to carry out chapter 1 of part I of the Foreign Assistance Act of 1961 may be used to employ up to 15 individuals on a limited appointment basis for activities related to the United States Global Development Lab pursuant to schedule A of the Excepted Service, or similar authority: , That such funds are in addition to funds otherwise available for such purposes.
