Sec. 901. Reorganization of the Office of the Secretary of Defense and related matters

Chapter 4 of title 10, United States Code, is amended by inserting after section 133 the following new section: There is a Chief Management Officer of the Department of Defense, appointed from civilian life by the President, by and with the advice and consent of the Senate. In addition to the responsibilities specified in subsection (c), the Chief Management Officer is also the following: The Chief Information Officer of the Department of Defense. The Performance Improvement Officer of the Department of Defense.
The Chief Management Officer is responsible, subject to the authority, direction, and control of the Secretary of Defense and the Deputy Secretary of Defense in the role of the Deputy Secretary as Chief Operating Officer of the Department of Defense, for the following: Assisting the Deputy Secretary of Defense in the Deputy Secretary’s role as the Chief Operating Officer of the Department of Defense under section 132(c) of this title. Supervising the management of the business operations of the Department of Defense and adjudicating issues and conflicts in functional domain business policies.
Establishing business strategic planning and performance management policies and measures and developing the Department of Defense Strategic Management Plan. Establishing business information technology portfolio policies and overseeing investment management of that portfolio for the Department of Defense. Establishing end-to-end business process and policies for establishing, eliminating, and implementing business standards, and the Business Enterprise Architecture. Exercising authority, direction, and control over the Information Assurance Directorate of the National Security Agency.
Discharging the responsibilities provided for in chapter 35 of title 44 and section 11315 of title 40 for chief information officers of executive agencies. In addition to discharging the responsibilities specified in paragraph (7)— reviewing and providing recommendations to the Secretary of Defense on Department of Defense budget requests for information technology and national security systems; ensuring the interoperability of information technology and national security systems throughout the Department of Defense; ensuring that information technology and national security systems standards that will apply throughout the Department of Defense are prescribed; providing for the elimination of duplicate information technology and national security systems within and between the military departments and the Defense Agencies; and maintaining a consolidated inventory of Department of Defense mission critical and mission essential information systems, identifying interfaces between such information systems and other information systems, and developing and maintaining contingency plans for responding to a disruption in the operation of any of such information systems.
The Chief Management Officer takes precedence in the Department of Defense after the Under Secretary of Defense for Acquisition, Technology, and Logistics and the Secretaries of the military departments. . Section 132a of such title is repealed. Section 131(b) of such title is amended— by striking paragraphs
(2)and
(3)and inserting the following new paragraph (2): The Under Secretary of Defense for Acquisition, Technology, and Logistics. The Chief Management Officer of the Department of Defense. The other Under Secretaries of Defense, as follows: The Under Secretary of Defense for Policy. The Under Secretary of Defense for (Comptroller) The Under Secretary of Defense for Personnel and Readiness. The Under Secretary of Defense for Intelligence. ; and by redesignated paragraphs

(8)as paragraphs
(3)through (7), respectively. The individual appointed by the President, by and with the advice and consent of the Senate, to serve as the Deputy Chief Management Officer of the Department of Defense as of the date of enactment of this Act shall serve as the Chief Management Officer of the Department of Defense under section 133a of title 10, United States Code (as amended by paragraph (1)), after that date. Subsection
(c)of section 132 of title 10, United States Code, is amended to read as follows: The Deputy Secretary serves as the Chief Operating Officer of the Department of Defense. In the Deputy Secretary's role as Chief Operating Officer of the Department of Defense, the Deputy Secretary shall exercise authority, direction, and control of the Chief Management Officer of the Department of Defense under section 133a of this title. . Paragraph

(a)of section 137a of title 10, United States Code, is amended by striking five and inserting seven . Subsection
(a)of such section is further amended by adding at the end the following new paragraph: The officials authorized under this section shall be the only Deputy Under Secretaries of Defense. . Section 906(a)(2) of the National Defense Authorization Act for Fiscal Year 2010 (10 U.S.C. 137a note) is repealed. Subsection
(b)of section 137a of title 10, United States Code, is amended by striking is absent or disabled and inserting dies, resigns, or is otherwise unable to perform the functions and duties of the office . Subsection
(b)of such section is further amended by adding at the end the following new sentence: For purposes of the preceding sentence and paragraphs

(7)of subsection (c), the Chief Management Officer of the Department of Defense shall be treated as an Under Secretary of Defense. Subsection
(c)of such section is amended by adding at the end the following new paragraphs: One of the Principal Deputy Under Secretaries is the Principal Deputy Under Secretary of Defense for Management. One of the Principal Deputy Under Secretaries is the Principal Deputy Under Secretary of Defense for Information. . Paragraph
(9)of section 138(b) of title 10, United States Code, is amended to read as follows: One of the Assistant Secretaries is the Assistant Secretary of Defense for Energy, Installations, and Environment. The Assistant Secretary— is the principal advisor to the Secretary of Defense and the Under Secretary of Defense for Acquisition, Technology, and Logistics on matters relating to energy, installations, and environment; and is the principal advisor to the Secretary of Defense and the Deputy Secretary of Defense regarding operational energy plans and programs. In the capacity specified in subparagraph (A)(ii), the Assistant Secretary may communicate views on matters related to operational energy plans and programs and the operational energy strategy directly to the Secretary of Defense and the Deputy Secretary of Defense without obtaining the approval or concurrence of any other official within the Department of Defense. . Chapter 4 of title 10, United States Code, is further amended as follows: Paragraph

Any reference to the Deputy Chief Management Officer of the Department of Defense in any provision of law or in any rule, regulation, or other record, document, or paper of the United States shall be deemed to refer to the Chief Management Officer of the Department of Defense. Any reference to the Chief Information Officer of the Department of Defense in any provision of law or in any rule, regulation, or other record, document, or paper of the United States shall be deemed to refer to the Chief Management Officer of the Department of Defense. Any reference to the Assistant Secretary of Defense for Operational Energy Plans and Programs or to the Deputy Under Secretary of Defense for Installations and Environment in any provision of law or in any rule, regulation, or other paper of the United State shall be deemed to the Assistant Secretary of Defense for Energy, Installations, and Environment.
