The Secretary, within 180 days of enactment, shall conduct a pre-hearing, public information session patterned on Part 900 of the CFR to consider proposals developed within the Department or submitted by interested persons of alternatives to end product pricing formulae: , That following this pre-hearing process, the Secretary retains discretion over whether to proceed to a full, formal hearing: Provided , That should the Secretary decide at the conclusion of the pre-hearing process not to proceed to a formal hearing, the Secretary shall submit a report to the Committee within 60 days of that decision setting forth in detail the rationale for that decision.
