Not later than 90 days after the date of the enactment of this Act, the President shall determine if Hezbollah meets the criteria specified for designation as a significant foreign narcotics trafficker under section 804 of the Foreign Narcotics Kingpin Designation Act ( 21 U.S.C. 1903 ). If the President determines under subsection
(a)that Hezbollah meets the criteria specified for designation as a significant foreign narcotics trafficker under section 804 of the Foreign Narcotics Kingpin Designation Act ( 21 U.S.C. 1903 ), the President shall designate Hezbollah as a significant foreign narcotics trafficker under that section. If the President determines under subsection
(a)that Hezbollah does not meet the criteria specified for designation as a significant foreign narcotics trafficker under section 804 of the Foreign Narcotics Kingpin Designation Act ( 21 U.S.C. 1903 ), the President shall submit to the appropriate congressional committees a report that contains a detailed justification as to which criteria have not been met. The report required under paragraph
(1)shall be submitted in unclassified form, but may contain a classified annex, if necessary.
