Section 1074(b)(6) of the National Defense Authorization Act for Fiscal Year 2008 ( Public Law 110–181 ; 10 U.S.C. 113 note) is amended— in subparagraph (A), by striking The Secretary and inserting Except as provided in subparagraph (B), the Secretary ; by redesignating subparagraphs
(B)and
(C)as subparagraphs
(C)and (D), respectively; and by inserting after subparagraph
(A)the following new subparagraph: The reporting requirement under subparagraph
(A)does not apply to determinations under paragraphs
(4)or
(5)to provide or extend protections to— individuals described under paragraph (2)(C) who are conducting official business with the Department of Defense as part of an officially sponsored event; or individuals described under paragraph (2)(E). .
