The Secretary, in consultation with the Administrator, shall establish and implement enforceable uniform national standards and requirements for the regulation of discharges incidental to the normal operation of a vessel. The standards and requirements shall— be based upon the best available technology economically achievable; and supersede any permitting requirement or prohibition on discharges incidental to the normal operation of a vessel under any other provision of law. The Secretary shall administer and enforce the uniform national standards and requirements under this Act. Each State may enforce the uniform national standards and requirements under this Act.
