Section 189 (29 U.S.C. 2939) is amended— in subsection (g)— by amending paragraph
(1)to read as follows: Appropriations for any fiscal year for programs and activities carried out under this title shall be available for obligation only on the basis of a program year. The program year shall begin on October 1 in the fiscal year for which the appropriation is made. ; and in paragraph (2)— in the first sentence, by striking each State and inserting each recipient (except as otherwise provided in this paragraph) ; and in the second sentence, by striking 171 or ; and in subsection (i)— by striking paragraphs
(2)and (3); by redesignating paragraph
(4)as paragraph (2); by amending paragraph (2)(A), as so redesignated— in clause (i), by striking ; and and inserting a period at the end; by striking requirements of subparagraph
(B)and all that follows through any of the statutory or regulatory requirements of subtitle B and inserting requirements of subparagraph
(B)or (D), any of the statutory or regulatory requirements of subtitle B ; and by striking clause (ii); and by adding at the end the following: The Secretary may establish an expedited procedure for the purpose of extending to additional States the waiver of statutory or regulatory requirements that have been approved for a State pursuant to a request under subparagraph (B), in lieu of requiring the additional States to meet the requirements of subparagraphs
(B)and (C). Such procedure shall ensure that the extension of such a waiver to additional States is accompanied by appropriate conditions relating to the implementation of such waiver. The Secretary shall not require or impose new or additional requirements, that are not specified under this Act, on a State in exchange for providing a waiver to the State or a local area in the State under this paragraph. .
