Section 8136(b) is amended by inserting , or the provision of services or conduct of a program pursuant to a contract or grant issued or awarded by the Secretary under subchapter II of chapter 20 or section 2031(a)(2) of this title, after outpatient clinic . The amendment made by subsection
(a)may not be construed to authorize the Secretary of Veterans Affairs to enter into a contract with a State home or award a grant to a State home for the furnishing of residential care for a veteran without— identifying a substantial need for such care; and determining that the State home is the most appropriate provider of such care.
