Sec. 631. Treatment of certain misfiled documents as a notice of appeal to the Court of Appeals for Veterans Claims

Section 7266 is amended by adding at the end the following new subsection: If a person adversely affected by a final decision of the Board, who has not filed a notice of appeal with the United States Court of Appeals for Veterans Claims under subsection (a), misfiles a document with the Board or the agency of original jurisdiction referred to in section 7105(b)(1) of this title that expresses disagreement with such decision and a clear intent to seek review of such decision by the United States Court of Appeals for Veterans Claims, not later than 120 days after the date of such decision, such document shall be treated as timely filed under subsection (a).
The treatment of misfiled documents under paragraph
(1)does not limit equitable relief that may be otherwise available to a person described in that paragraph. .
