Sec. 603. Report on standard of proof for service-connection of mental health conditions related to military sexual trauma

Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the current standard of proof for service-connection under chapter 11 of title 38, United States Code, for covered mental health conditions based on military sexual trauma. The Secretary shall include in the report under subsection
(a)any recommendations the Secretary considers appropriate to improve the adjudication of claims for compensation based on military sexual trauma, including— recommendations for an appropriate standard of proof for such claims if the Secretary considers such recommendations advisable; and recommendations for legislative action, if necessary, to carry out such improvement. In this section: The term active military, naval, or air service has the meaning given that term in section 101 of title 38, United States Code. The term covered mental health condition means post-traumatic stress disorder, anxiety, depression, or other mental health diagnosis that the Secretary determines to be related to military sexual trauma. The term military sexual trauma shall have the meaning specified by the Secretary for purposes of this section, and shall include sexual harassment (as so specified).
