Section 1848(c)(2)(B)(iii) of the Social Security Act ( 42 U.S.C. 1395w–4(c)(2)(B)(iii) ) is amended by adding at the end the following new sentence: The Secretary may not consult with an organization representing physicians if the organization uses a group to formulate recommendations regarding adjustments under clause
(i)unless at least 40 percent of the members of the group are physicians who are board certified and actively practicing in family medicine, general internal medicine, general pediatrics, preventive medicine, obstetrics and gynecology, or psychiatry. .
