Section 1886(d)(12) of the Social Security Act ( 42 U.S.C. 1395ww(d)(12) ) is amended— in subparagraph (B)— in the subparagraph heading, by inserting after for fiscal years 2005 through 2010 ; and increase in the matter preceding clause (i), by striking and for discharges occurring in fiscal year 2014 and subsequent years ; in subparagraph (C)(i), by striking fiscal years 2011, 2012, and 2013 and inserting fiscal year 2011 and subsequent fiscal years each place it appears; and in subparagraph (D)— in the heading, by striking and inserting Temporary applicable percentage increase ; and Applicable percentage increase for fiscal year 2011 and subsequent fiscal years by striking fiscal years 2011, 2012, and 2013 and inserting fiscal year 2011 or a subsequent fiscal year ;
Notwithstanding any other provision of law, the Secretary of Health and Human Services may implement the provisions of, and the amendments made by, this section through program instruction or otherwise.
