Section 17 of the Mineral Leasing Act (30 U.S.C. 226) is amended— by striking S and inserting the following: ec. 17.
(a)All lands All land ; and in subsection
(a)(as amended by paragraph (1)), by adding at the end the following: In conducting lease sales under this section, each year, the Secretary shall offer for sale not less than 25 percent of the annual nominated acreage not previously made available for lease. The offering of acreage offered for lease under this paragraph shall not be subject to review. Acreage offered for lease under this paragraph shall be eligible for categorical exclusions under section 390 of the Energy Policy Act of 2005 ( 42 U.S.C. 15942 ), except that extraordinary circumstances shall not be required for a categorical exclusion under this paragraph. In carrying out this subsection, the Secretary shall only consider leasing of Federal land that is available for leasing at the time the lease sale occurs. .
