In this section— the term agency — means an Executive agency as defined under section 105 of title 5, United States Code; and does not apply to the Department of Defense; and the term Federal employee means an employee as defined under section 2105 of title 5, United States Code. Federal employees in each agency shall be managed each fiscal year solely on the basis of, and consistent with— the workload required to carry out the functions and activities of that agency; and the funds made available to that agency for that fiscal year.
Notwithstanding any other provision of law— the management of Federal employees in any fiscal year shall not be subject to any limitation in terms of work years, full-time equivalent positions, or maximum number of Federal employees; and an agency may not be required to make a reduction in the number of full-time equivalent positions, unless that reduction is— necessary due to a reduction in funds available to the agency; or required under a statute that— is enacted after the date of enactment of this Act; and specifically refers to this section.
