The Secretary shall prescribe by regulation, for application in the current fiscal year and in subsequent fiscal years, a schedule of fees for certification of health information technology as established by section 300jj–11(c)(5) of title 42. The fees shall be paid by health information technology vendors based on the fee structure established by the Secretary and published in the Federal Register. The Secretary shall periodically update this schedule of fees through a notice in the Federal Register.
This fee structure shall be designed to be sufficient to recover costs associated with the administration of certification programs authorized by section 300jj–11(c)(5) of title 42, including the costs for health information technology standards, testing and certification, and other related costs for improving the efficiency of certification programs. The Secretary shall prescribe procedures to collect the fees. The Secretary may, for the purpose of collecting fees, use the services of a department, agency, or instrumentality authorized by the National Coordinator to perform the certification of health information technology in accordance with section 300jj–11(c)(5) of title 42, and may reimburse such department, agency, or instrumentality a reasonable amount for its services.
Fees collected under this section shall be deposited in the HHS Office of the National Coordinator for Health Information Technology account as offsetting collections. Such fees shall be collected and available only to the extent and in such amounts as provided in advance in appropriations acts.
