Section 12113 of title 46, United States Code, is amended by adding at the end the following: Paragraph

(3)of subsection

(a)shall not apply to any vessel— the catch of which, pursuant to the fishery endorsement, is offloaded and processed in American Samoa; and that was rebuilt outside of the United States before January 1, 2011. .
