Sec. 642. Effect on division of retired pay of election to receive combat-related special compensation after previous election to receive concurrent retirement and disability compensation

Section 1414(d) of title 10, United States Code, is amended by adding at the end the following new paragraph: An election by a member pursuant to paragraph
(2)to change from receipt of retired pay in accordance with this section to receipt of special compensation in accordance with section 1413a of this title shall not affect payments made before the date of such election to the member’s spouse or former spouse pursuant to section 1408 of this title of disposable retired pay that a court treated as property for the purpose of issuing a final decree of divorce, dissolution, annulment, or legal separation, including a court ordered, ratified, or approved property settlement incident to such decree. In this paragraph: The term court has the meaning given such term in section 1408(a)(1) of this title. The term disposable retired pay has the meaning given such term in section 1408(a)(4) of this title. The term final decree has the meaning given such term in section 1408(a)(3) of this title. The term member has the meaning given such term in section 1408(a)(5) of this title. The term spouse or former spouse has the meaning given such term in section 1408(a)(6) of this title. . Paragraph
(3)of section 1414(d) of title 10, United States Code, as added by subsection (a), shall apply with respect to payments made under section 1408 of title 10, United States Code, on or after the date of the enactment of this Act.
